Court finds no link between boy’s lead poisoning and Mt Isa Mine.

Mt Isa MineThe Supreme Court has found no definite causal link between the operations of Xstrata’s Mount Isa Mines and the alleged lead poisoning of local Mount Isa boy, Sidney Body.

The boy’s mother, Sharlene Body launched a $1 million law suit against Mount Isa Council and the Queensland Government in 2011 after finding out her son Sidney recorded blood lead levels three times more than the recommended safe limit.

Supreme Court Justice David Boddice reportedly struck out pleadings from Slater and Gordon Lawyers, claiming they failed to disclose a cause of action against Xstrata and had also failed to show a causal link between the mining company’s alleged breach of duty and Sidney Body’s injuries.

News Limited reported Ms Body, acting on behalf of her son Sidney, was considering her options after the decision, which could impact five other ongoing cases against the mine.
