New NSW Health And Safety Mining Laws In Place

New laws in NSW for workplace health and safety in mines

February 1 was the start date for New South Wales’ new mining health and safety laws, replacing the Coal Mine Health and Safety Act 2002 and the Mine Health and Safety Act 2004 with the Work Health and Safety (Mines) Regulation 2014. 

The new laws mean there will no longer be separate mine safety legislation for coal mines, metalliferous and extractives mines. They were created with the intention of increasing harmonisation between Australia’s states and territories, and were developed in consultation with the major mining states of Queensland and Western Australia.

The new regulations includes amendments to draft regulation identified during the public consultation process, and these amendments have retained existing NSW legislative requirements that achieve consistent safety standards without increasing regulatory cost.
