Safety Act passed in NSW

The NSW Parliament has passed the Work Health and Safety (Mines) Act 2013 .The Act was assented on 1 July 2013 but will not commence until the making of the supporting Work Health and Safety (Mines) Regulation.

The Work Health and Safety (Mines) Act 2013 is another important step towards the harmonisation of work health and safety laws for mining.

The Work Health and Safety (Mines) Regulation that will support the Work Health and Safety (Mines) Act 2013 is currently being drafted based on the national model WHS (Mines) Regulation and the additional tri-state mining provisions agreed by NSW, Queensland and Western Australia.

A comprehensive public consultation process will be undertaken on the draft Work Health and Safety (Mines) Regulation for NSW. The process will include the release of a public consultation draft of the regulation, a discussion paper and a regulatory impact statement.

The Work Health and Safety (Mines) Act 2013 is available on the NSW legislation website.

Information on the national harmonisation process is available on the Mine Safety website.
