Resources Regulator commences prosecution proceedings against Boral Resources (NSW) Pty Ltd

The NSW Resources Regulator has commenced prosecution proceedings against Boral Resources (NSW) Pty Ltd, the operator of Peppertree Quarry, located near Marulan.

The Regulator alleges in 28 separate charges that Boral Resources (NSW) Pty Ltd contravened clause 49 of the Work Health and Safety Regulation 2017 in 2018 and 2019 by exposing workers at the Peppertree Quarry to airborne concentrations of crystalline silica which were above legislated exposure standards. The Regulator also alleges that in 2018 Boral Resources (NSW) Pty Ltd failed to notify it of 8 instances in which respirable dust and silica exposure standards at the quarry were not met, as required by clause 128 of the Work Health and Safety (Mines and Petroleum Sites) Regulation 2014.

The matters are set for mention at Downing Centre Local Court on 17 August 2020.

Each offence carries a maximum penalty of $30,000.
